What a franchise buyer in New Brunswick is entitled to
No franchise statute here
New Brunswick has no franchise-specific legislation. A franchisor here is under no statutory duty to give you a disclosure document before you sign, and there is no statutory rescission right if the information turns out to be incomplete — you have the general law of contract and whatever the franchise agreement itself provides. Ask for the disclosure the other provinces mandate anyway; a franchisor that operates nationally already produces one.
The franchisor still has to approve you
A resale is bought from the existing franchisee, but essentially every franchise agreement makes transfer conditional on the franchisor’s consent — and often on a transfer fee, the buyer completing training, and the premises meeting the current build standard. Those conditions sit outside the purchase agreement and are the most common reason a franchise resale slips its closing date.
