Disclosure law where Presse Café is listed

Ontario, the only province with Presse Café listings, has a franchise disclosure statute. Ontario’s Arthur Wishart Act (Franchise Disclosure), 2000 requires a franchisor to provide a disclosure document that the prospective franchisee receives not less than 14 days before the earlier of signing the franchise agreement or any other agreement relating to the franchise and paying any consideration to the franchisor or its associate relating to the franchise (s.5(1), subject to the agreements and deposits it excludes and to s.5(7), which lists grants to which the section does not apply). A franchisee may rescind, without penalty or obligation, no later than 60 days after receiving the disclosure document if the franchisor failed to provide it or a statement of material change within the time required by section 5 or its contents did not meet section 5, or no later than two years after entering into the franchise agreement if the franchisor never provided it (s.6(1)–(2)).
