Class A liquor licence (Alberta)
An Alberta Class A liquor licence lets a licensee sell liquor from premises open to the public, for consumption on the premises and off them. The licence cannot be sold, assigned or transferred, and some changes in ownership must be reported to the Alberta Gaming, Liquor and Cannabis Commission (AGLC) and approved by its board first.
The AGLC lists liquor licences in Classes A to F. Its Class A page describes minors-allowed licences, where food service is the main source of business, minors-prohibited licences, where liquor is the main source of business, and a manufacturer’s taproom licence. Under section 35 of the Gaming, Liquor and Cannabis Regulation, a Class A licence authorizes the licensee, among other things, to sell or provide liquor from the licensed premises for consumption in them and off them. Section 36 requires premises that any member of the public may enter.
What a sale does to the licence
Section 76 says neither the holder of a liquor licence nor a person registered under that Part may sell, assign or transfer the licence or registration, and that doing so cancels it. Under section 76.1, the board may cancel a licence if a sale, assignment or transfer of a portion of the business under which the licensed activities are carried out results in a change in control of the business. Under section 76.2(1), a proposed sale, assignment or transfer of a portion of such a business must be reported to the Commission by the licensee and approved by the board before its effective date for a sole proprietorship, partnership or corporation that is not a distributing corporation; section 76.2(2) sets a different rule for distributing corporations.
