eManifest
eManifest is the Canada Border Services Agency system for sending cargo and conveyance data electronically before goods arrive in Canada. The CBSA says highway carriers bringing goods into Canada must transmit that data electronically before arrival.
A buyer of a trucking company that crosses the border meets eManifest in the carrier’s filing practice and in its carrier code. The duty is federal. See what to check before buying a trucking company.
What the law and the CBSA say
Section 12.1 of the Customs Act requires the owner or person in charge of a conveyance who is prescribed, or any other prescribed person, to give the Agency prescribed information about the conveyance and the persons and goods on board or expected to be on board before it arrives in Canada; regulations under section 12.1(8) set what information, by whom, when and how. A person who must give that information must hold a valid carrier code unless exempt. The CBSA says the eManifest Portal is one option for transmitting data, and an applicant who wants to use it indicates so on the carrier code application in the CARM Client Portal.
What to check or ask
- Ask which entity holds the carrier code and whether it stays with the business being bought. See CBSA carrier code.
- Ask how the carrier transmits its data today and who holds the portal access.
- Ask for any CBSA correspondence about late or missing data.
- Confirm with the CBSA whether a new owner must apply for anything.
