Menu labelling requirements

Menu labelling requirements are Ontario rules under the Healthy Menu Choices Act, 2015 and O. Reg. 50/16 that make covered food-service chains post the calories in their standard food and drink items. Inspectors from local public health units enforce them.

A buyer of a chain restaurant, coffee shop or similar outlet in Ontario meets this when reading the menus, boards and tags. This entry covers Ontario only; check the rules where the business is. See how to buy a restaurant in Ontario.

What the Ministry of Health says it requires

  • Calories for standard food items appear on menus, menu boards, tags, labels or signs.
  • A standard food item is a restaurant-type food or drink that is standardized for portion and content, is served or prepared primarily in a regulated premises, and is meant for immediate consumption.
  • Businesses also post a statement giving context on average daily calorie needs.
  • For self-serve items, a sign must show the item name, calories, serving size and the word “Calories” or an accepted short form, unless a compliant label or tag on each item sets out the same information. The Ministry lists free self-serve condiments not on the menu among its examples of exempt items.

Enforcement and what to ask

The Ministry says public health unit inspectors visit covered businesses and respond to complaints, which can lead to education, a warning and then a fine. Ask whether the outlet counts as covered, for example through the number of the chain’s locations in Ontario, and whether any inspection notes exist. Check each menu, board and tag against the current rules. See also food premises permit.
